Proud Boys Fight Back




Proud Boy memebrs Enrigue Torrio, Zarary Rehl, Ethan Nordean, Joseph Biggs, and Dominic Pezzola Have filed court action against the United States Goverenment, DOJ, FBI Special Agent Nicole Miller, and John Doe Nod. I-X ( Unknown members of the FBI and DOj) in the Uinted States District Court for the Middle District of Florida (Orlando Division).
 The Proud Boys managing members, legally referred to as the plaintiffs in their court filings, are seeking an award of damages for acts undertaken by the defendants, the  Federal agents, in violation of their fourth, fifth, and Sixth amendment rights. malicious prosecution, and false imprisonment. The award for damages  is based on a 1971 supreme court ruling, Bivens vs Six Unknown Federal Narcotics Agents. It is more commonly known, in legal speak, as a action
The paintifs are represented by  Thomas F. Ranieri, Esq of the Ranieiri and Associates law firm in Front Royal, Virginia. In the 28 page filing the plaintiffs refer to the actions against the Proud Boys as a “parade of horribles” . They claim that the Federal government used evidence tampering, witness intimidation, violations of attorney-client-privilege , and placed government controlled within their legal team. 
In the filing the plaintiff's accuse FBI Special Agent Nicole Miller of destroying evidence, using her government powers to “de-bank” them from their financial institutions, destroy their businesses , and remove their federal benefits(military retirement).
The plaintiffs suggest that under great zeal, litigators for the government invented a new legal tactic dubbed the “Tool Theory”. That is,  someone could be convicted for conspiracy with people over whom they had no authority and to whom they gave no orders. The "Tool Theory” is rooted in the science of stochastic terrorism. “Stochastic Terrorism" is a term coined by a Singaporean Mathematician who studied terrorism effects out of  the University of Florida named Dr. Gordon Woo. He is a risk analyst.
Think about it. Could someone's blog or online website be encompassed under the umbrella of the “TOOL THEORY”? creating a criminal liability for an act of terrorism that the government wants to associate with a news story from an author who writes contrary to their point of view or political position.
In addition, the plaintiffs have pointed out, in the filing, after each plaintiff surrendered peacefully, Joe Biggs, who was a former Infowars.com journalist, drove to the FBI office and surrendered, the government soldiers raided their homes and used heavy handed  revenge tactics against their ftmilm members. Farthermore, they claim S.A. Miller has chat logs discussing conversations between Mr. Rehl and his attorney. Shocking! Lastly they claim Government Agents used their power under the color of law to intimidate a witness to not testify. 

The Plaintiffs, Proud Boys, or J6 Defendants are asking for a Jury trial and $100,000,000 damages

 While there is no explicit right to file a civil lawsuit against federal government officials who have violated the Fourth Amendment, this right can be inferred. This is because a constitutional protection would not be meaningful if there were no way to seek a remedy for a violation of it.

 

Background

 
   

On or about 6:30 am in the morning of November 26,1965, Webster Bivens apartment was raided by five Federal Narcotics Agents without a warrant. He was forcibly handcuffed  in front of his family and later forced to undergo strip search in a Federal Court house. Later, a United States Commissioner found the agents acted without a search or arrest warrant, and dismissed the case. Mr. Bivens, pro si, filed a complaint in Federal Court

Proud Boy Organizer Jen Loh Calls The Gateway Pundit to Tell Her Side of the Story on Previous Work with FBI

       An advisor to the litigants, who goes by the  nom de guerre Jen Loh  (JENNILYNN LOHMER SALINAS), had been coaching and associating with the patriotic organization about legal matters. It appears she was deep inside, not only with the proud boys members, but also the legal team defending the litigants during their J6 defense. Astonishing, after hearing Jen Loh was a well placed confidential infomant US District judge Tim Kelly allowed the trial to continue. Judge Kelly was appointed to the bench by President Donald Trump. In addition, it has been reported that “Jen Loh” had some dust up with Antifa. She claims in a telephonic interview with John Loft on the Gateway Pundi , That she was reporting to the FBI on Antifa for many years, However,  she claims she never received funding as a confidential informant for the FBI. She also claims to have interfaced with Senator Ted Cruz 'office regarding matters of Antifa. Interesting indeed!
